5 Issues in to App of Lodsys-purchase of patent claims

Threatening society continue developers third iOS if they get a patent rights concerning the iOS app purchase mechanism recently posted a series of Q & A on his blog. The company, Lodsys licence, began to send letters Friday at least seven small developers iOS demanding that they pay for the use in the app purchases in their iPhone and iPad software.

Apple opened in app purchasing capabilities to developers third iOS with the release of the iOS iPhone 3 in 2009. Since then, apps, magazines, comic books, from the sale of additional levels in the games and most embraced the ability to increase their sales. But now, it appears that the increase in sales comes at a cost beyond 30% of Apple reduction. It is not clear if Lodsys claims the rights of patent on all purchases-app or only certain types of purchases. So far, it appears Lodsys wants that the remuneration of persons offering upgrades and renewals of subscription as well as help online and interactive online advertisements.

Lodsys said it is fair to assert its rights to these patents, but it is also not clear if the company goes after each developer app iOS or small sponsors that could not possibly mount a court challenge.

Lodsys blog is worth reading, but here are five interesting things to note about the breakup of patent iOS.

Apple is allowed.

Lodsys denies that its strategy is to go after small developers in the hope of forcing Apple to this patent.

Apple is authorized to use the technology covered by this patent, said Lodsys.

Apple cannot license it?

Apple could be permitted to use it, but the company is not permitted to share the technology-app purchase with its community of third-party developer for free, according to Lodsys.

"The scope of the current licences their [Apple] does not provide"pixie dust"to bless another (3rd part) business applications,"writes Lodsys."."

If this is true, and legally valid, which raises serious questions for Apple. If the company encouraged its developers to use technology that apple was not intended to give away for free without informing officials APA, it might be more certain prosecutions come, directed against Apple.

However, Apple has an indemnity clause in the iOS developer agreement says the company is not responsible for the prosecution of developers third party app.

DEVS weapons are blocked

TidBITS has a great write-up on the situation of developers iOS, based on the agreement of developer iOS. Transforms, Apple iOS devs may not able to take any legal action on their own to settle with Lodsys since it could undermine business of Apple.

The developer agreement requires that developers to "cooperate with Apple to maintain ownership of Apple" iOS and iOS SDK, including the developer has as the app purchases. Developers are also required to notify Apple if they continue on something that is in the Apple software. Apple also prohibits developers to enter institutions or agreements affecting "rights of Apple or Apple-binding in any way, without the prior written consent of Apple."

Just enough to wet my beak

How so does Lodsys?

The company says that for an application a upgrade-app (Lodsys does not specify what is considered an upgrade) to sell the company wants to 0.575 per cent of the revenue or $ 5,750 for each $ 1 million. ? The company says also it does not seek to stifle innovation, but its purpose is of "popularize the technology, it used by many people and to relatively small amounts by the holder of the licence, but having the large volume of licensees overall a useful activity."

Android, Windows phone Devs can be

Lodsys says that, like Apple, Google and Microsoft are registered for their "nameplate products and services."

The company does not come right out and say so, but Lodsys could be looking then goes after the third-party developers for Android and Windows phone. But based on license agreements Google and Microsoft have with Lodsys.

Apple strikes back?

The big question is this type of position Apple will have on the actions of the Lodsys.

Apple is requiring that all applications of iOS sell subscriptions mechanism of purchase-app to Apple by June 30. That would automatically expose more dev elopers to legal action possible in Lodsys no fault on part of the developer.

Also, if small developers eventually pay to Lodsys on this patent, how many other patent holders (or trolls, depending on your point of view) will attempt to obtain a fee from the small percentage of developers mobile app?

Whatever happens, it is Apple interests and Google and Microsoft, possibly to resolve this problem for third-party developers before disappearing from their app stores respective apps. A developer, plans of James Thomson on retains the releasing the next version of its app PCalc until he understands better her legal situation, according to Macworld.
